1. Acceptance of Terms

By accessing or using The Dolla Bin ("the Platform," "we," "us," or "our") at thedollabin.com, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Platform. We reserve the right to modify these Terms at any time. Continued use of the Platform after changes constitutes acceptance of the revised Terms.

2. The Platform Is a Marketplace

The Dolla Bin is a listing and discovery platform that connects collectors and sellers of vinyl records. We are not a party to any transaction between buyers and sellers. We do not buy, sell, or take possession of any items listed on the Platform. All transactions, payments, and arrangements are made directly between buyers and sellers.

We have no control over the quality, safety, legality, or availability of items listed, the accuracy of listings, the ability of sellers to sell, or the ability of buyers to pay. We are not responsible for any aspect of a transaction that occurs outside the Platform.

3. Accounts and Eligibility

You must be at least 18 years old to create an account. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to provide accurate, current, and complete information during registration and to update it as necessary.

We reserve the right to suspend or terminate any account at our sole discretion, with or without notice, for any violation of these Terms or for any other reason we deem appropriate.

4. Seller Subscriptions

Access to listing features requires an active subscription. Subscription fees are billed in advance and are non-refundable except as required by applicable law. We reserve the right to change subscription pricing with reasonable notice. Downgrading or canceling a subscription does not entitle you to a refund of any prepaid fees.

Free-tier accounts are limited to 3 active listings. "Active" includes draft, published, and paused listings. Paid (Dealer) accounts have no listing cap.

5. User Content

You retain ownership of content you submit to the Platform (listings, photos, descriptions, profile information). By submitting content, you grant us a worldwide, non-exclusive, royalty-free license to use, display, reproduce, and distribute that content in connection with operating the Platform.

You represent and warrant that: (a) you own or have the right to submit the content; (b) the content does not infringe any third-party intellectual property rights; and (c) the content is accurate and not misleading.

We reserve the right to remove any content that violates these Terms or that we deem inappropriate, without prior notice.

6. Prohibited Conduct

You agree not to:

List counterfeit, stolen, or misrepresented items
Engage in price manipulation, shill bidding, or fraudulent activity
Harass, threaten, or abuse other users
Circumvent any technical measures or access controls
Use the Platform for any unlawful purpose
Scrape, crawl, or systematically extract data from the Platform without written permission
Impersonate any person or entity
Attempt to interfere with the integrity or availability of the Platform

7. Transactions Between Users

All sales, purchases, and exchanges facilitated through the Platform are solely between the buyer and seller. The Dolla Bin is not responsible for any loss, damage, or dispute arising from a transaction between users. We strongly encourage users to exercise caution and good judgment when transacting with others.

We may, at our sole discretion, assist in resolving disputes between users, but we have no obligation to do so and our involvement does not create any liability on our part.

8. Disclaimer of Warranties

THE PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ANY WARRANTIES ARISING FROM COURSE OF DEALING OR USAGE OF TRADE. WE DO NOT WARRANT THAT THE PLATFORM WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

9. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, THE DOLLA BIN AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATED TO YOUR USE OF OR INABILITY TO USE THE PLATFORM, REGARDLESS OF WHETHER WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATED TO THESE TERMS OR THE PLATFORM SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE TWELVE MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED DOLLARS ($100).

10. Indemnification

You agree to indemnify, defend, and hold harmless The Dolla Bin and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or related to: (a) your use of the Platform; (b) your violation of these Terms; (c) your violation of any rights of another user or third party; or (d) any transaction you enter into through the Platform.

11. Intellectual Property

The Dolla Bin name, logo, and all Platform content created by us (excluding user-submitted content) are protected by copyright, trademark, and other intellectual property laws. You may not use our trademarks or reproduce our proprietary content without our express written permission.

12. Third-Party Services

The Platform integrates with third-party services including Stripe (payment processing), Discogs (music database), and eBay (external search results). Your use of these services is subject to their respective terms and privacy policies. We are not responsible for the content, practices, or availability of any third-party service.

13. Termination

Either party may terminate your account at any time. Upon termination, your right to use the Platform ceases immediately. Provisions of these Terms that by their nature should survive termination shall survive, including but not limited to Sections 8, 9, 10, and 14.

14. Governing Law and Disputes

These Terms are governed by the laws of the State of California, without regard to conflict of law principles. Any dispute arising out of or related to these Terms or the Platform shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association, except that either party may seek injunctive or other equitable relief in any court of competent jurisdiction. You waive any right to participate in a class action lawsuit or class-wide arbitration.
